- using the Services (as defined under Havnly's Terms of Service), which includes the Property Owner portal, the Insurance Partner portal, and any other Havnly-operated systems.
Havnly respects your privacy and is committed to protecting your Personal Information.
By accessing the Website and using our Services, you agree to the terms of this Privacy Policy, and you consent to Havnly's collection, storage, use and disclosure of your Personal Information as described in this Privacy Policy. Should you not accept and agree with this Privacy Policy, please refrain from using and/or accessing Havnly's Website and Services immediately.
1. Personal Information We Collect from You
The term "Personal Information", or personal data, means any information about an individual from which that person can be identified. Personal Information does not include data where the identity of the individual has been removed (i.e., anonymous data).
Havnly collects, uses and stores Personal Information you provide to us, which may include your name, email address, phone number, company name, and job title. We may also collect and store your account login credentials, housing request details, property listings, claim references, and any other transaction-related information you provide to us.

Havnly uses various methods to collect Personal Information from and about you including through:
- Direct interactions. You may provide us with your Personal Information such as your identity and contact data by filling in forms or by corresponding with us via email. This includes Personal Information you provide when you:
- create a User Account on our Website;
- use the Services.
3. How We Use Your Personal Information
We may process and use your Personal Information for the following purposes:
- Operate, maintain, and improve our Services.
- Facilitate housing matches and coordinate bookings between property owners and insurance partners.
- Communicate with you about transactions, updates, and support.

Where you opt in to receive text messages from Havnly, we collect your mobile phone number and a record of your consent to send you SMS communications, including housing-placement updates, booking and transaction notifications, property-listing coordination, account notifications, and support messages. Message frequency varies. Message and data rates may apply. You may withdraw your consent at any time by replying STOP. For assistance, reply HELP or contact legal@havnly.ai. Consent to receive text messages is not a condition of purchasing or using Havnly's services.
The overall purpose of our processing of your Personal Data is to manage your access to, and your use of, our Services and to develop and improve our business and your customer experience.
4. How We Share Your Personal Information
Havnly may share your Personal Information with:
- Other Platform Users — including property owners, insurance carriers, and relocation agents, when necessary to fulfill housing placements.
- Third Party Service Providers — who perform functions on our behalf (including hosting, analytics, payments, and compliance checks).
- Business Partners — such as integrated housing networks or relocation companies.
- Legal Authorities — when required by law, regulation, or legal process, or to protect our rights and safety.
Mobile Information and SMS Consent
Notwithstanding any other provision of this Privacy Policy, Havnly does not sell, rent, share, or disclose mobile phone numbers, SMS opt-in data, or messaging consent information to third parties or affiliates for their marketing or promotional purposes.
Mobile phone numbers, SMS opt-in data, and messaging consent may be disclosed only to vendors and service providers that help Havnly operate its messaging program, such as telecommunications providers, messaging platforms, and customer-support providers. These parties may use the information only to provide services to Havnly and may not use it for their own marketing or promotional purposes.
SMS opt-in consent is specific to Havnly and will not be transferred, shared, or disclosed to any third party or affiliate for marketing or promotional purposes.
5. Data Security and Disclaimer of Liability
Havnly implements reasonable physical, electronic, and administrative safeguards to protect your Personal Information, which include user authentication (including multi-factor authentication), role-based authorization, data encryption at rest, in transit, and field-encrypted passwords which are designed to protect your information from unauthorized access and potential security breaches.
We will notify you and any applicable regulator of a breach where we are legally required to do so.
You acknowledge that no data transmission over the Internet or wireless network can be guaranteed. Therefore, while Havnly strives to protect your Personal Information, you acknowledge that (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity, and privacy of any and all information and data exchanged between you and another registered user on the Website and/or the Services cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third-party, despite our best efforts.
To the fullest extent permitted by law, Havnly disclaims all liability for any unauthorized access to or use of your Personal Information, unless such breach is caused solely by Havnly's gross negligence or willful misconduct.
6. Where Your Personal Information is Stored
All Personal Information is stored securely on Postgres, a Relational Database Management System, served through Supabase.
7. Data Retention
Havnly will only retain your Personal Information for as long as (i) you are a registered user on the Website; and (ii) is reasonably necessary to fulfil the purposes we collected such Personal Information for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We will not retain Personal Information for longer than seven (7) years after account closure, unless required by law. We may retain your Personal Information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. When your Personal Information is no longer needed for the purpose for which such Personal Information was collected, we will take reasonable steps to destroy, delete or permanently de-identify your Personal Information.
8. International Data Transfers
Please note that should you access our Website and Services from outside the United States, your Personal Information will be transferred to and processed in the United States, where data protection laws may differ from those in your respective country.
9. Your Rights
Your rights under the California Consumer Privacy Act and California Privacy Regulation Act (CPRA)
To the extent that the California Consumer Privacy Act (CCPA) and California Privacy Regulation Act (CPRA) is applicable to either Havnly or you: both parties agree to comply with all of its obligations under the CCPA and CPRA; and in relation to any communication of 'Personal Information' as defined by the CCPA and CPRA, the parties agree that no monetary or other valuable consideration is being provided for such Personal Information and therefore neither party is 'selling' (as defined by the CCPA and CPRA) Personal Information to the other party.
The principal rights you have under the CCPA and CPRA include but are not limited to:
- Right to know: You have the right to request that we provide you with details of the Personal Information (pertaining to you specifically) that we collect, use, disclose and sell. To submit a request, please submit an email request to legal@havnly.ai and include 'CCPA Right to Know' in the subject line.
- Right to delete: You may request the deletion of Personal Information that we collect or hold about you. To submit a request to delete Personal Information, email your request to legal@havnly.ai and include 'CCPA Request to Delete' in the subject line.

Your Rights Under the Virginia Consumer Data Protection Act (VCDPA)
